TERMS & CONDITIONS APPLYING TO RENTALS OF APARTMENTS The Owner accords to the Client a short-term residence or 'holiday home', in accordance with the conditions stated below, which the Client must adhere to. The above-mentioned residence is to be used only for personal use, and under no means is to be used for any professional purposes, or as a business unit or office. The Client understands and accepts that the accommodation and services are only provided in the framework of a business or pleasure trip to Paris and that this is the principle underlying condition to the validation of this contract. The Client (including all accompanying family members and acquaintances) agrees to commit no act that could disturb the tranquility of the other residents of the building where the rental occurs. Any disorderly or unruly behavior is the sole responsibility of the Client and the Owner relinquishes complete and absolute responsibility if a third party is involved. The Client must comply with the building regulations. Animals are not allowed in the apartment except through prior arrangement. Our apartment is NON SMOKING. During the rental of the apartment, the Owner reserves the right to conduct urgent work in the apartment (agreed to with the Client), without affecting the negotiated price. the Client agrees to allow the Owner access into the apartment with prior notice of at least one day (except in cases of emergency), in order to accomplish these tasks. The Owner cannot be held responsible: For the temporary defect of equipment, for electricity power cuts, for a water reduction cuts through no fault of his/her own, for loss, breakage or injury due to weather conditions, riot, strike or any other circumstances independent of his/her will.
The Client understands that the Owner undertakes no responsibility for the Client's personal belongings and that in case of loss, damage, or theft to Client's personal property. The Client shall not attempt to recover damages from the Owner. The Client is responsible for any defacement to the apartment during his/her stay. The Client shall exercise reasonable caution to prevent the occurrence of theft including locking all doors and windows during the times that he/she is not inside the apartment. In case of theft the Client agrees to be responsible (either personally or through Client's insurer) for items and furnishing belonging to the Owner that are not included in the Owner's insurance policy. I. The Contract Until the First Payment has been paid, no reservation can be guaranteed. After booking, a contract will be sent to you by e-mail written with your name and with the dates of your reservation. We ask you to print out said contract and carry it with you upon your arrival. In signing, the tenant declares to be over 18 years old and accepts the Terms and Conditions of this contract. II. Your Stay
The rental begins at noon and ends at 10:00 a.m. on the dates defined in the contract. The Client must inform the Owner in advance the day and time of their arrival. The check-in process must be completed by 6:00 P.M. If a special check-in time is requested after 6:00 P.M. a special service may be hired, if available. In that case, the Owner must assess an additional charge of 70 Euros to cover the additional cost of the check in process. The length of stay of this contract can only be extended with the written agreement by the Owner and for no longer than a period of three months. For a departure before the negotiated date the tariff remains the same as already agreed between the Owner and the Client. III. Pricing The agreed upon rental fee includes: Linens, towels (changed every week), standard kitchen utensils, water, electricity *, local fixed telephone calls (incoming and outgoing), international fixed line calls to 70 destinations like the US, Canada, Australia, Japan and all European countries....(the list is available upon request), broadband internet, free video on demand services provided by the broadband operator, all taxes, and cleaning for one week stay. The agreed upon rental fee does not include: - Calls to mobile phones -*Electricity: for stays > 1 month - Extra cleaning (on request)
IV. Payment
1. Reservation Payment: 50% of the rental The payment has to be done by wire transfers to the Owner’s bank account (+15 euro bank fee) or by PAYPAL (+3.4% fee).
2. Final Payment: Payment either made before your arrival by wire transfers (+15 € fee), by PAYPAL (+3.4% fee) or upon your arrival in cash (Euros only).
3. Security Deposit Payment: To be made before your arrival by wire transfers (+15 € fee), by PAYPAL (3.4% fee) or upon your arrival in cash (EURO, GBP, USD, CAD, AUD and JPY accepted), in Travellers cheques or in Bank cheques payable in France.
V. Security Deposit
The deposit given by the Client guarantees the Owner payment for any damage made by the Client to any appliances, furniture, upholstery, kitchen utensils, linens, towels, etc. The security deposit covers any damage to the apartment noted by the Owner and includes any lost or missing keys to the apartment. In the case of missing keys, the Owner will change the apartment door lock and the Client will be billed the corresponding amount which is usually between € 400 - € 600.
Up to 1 month rental: the security deposit is equal to the rent Between 1 month rental and 3 months rental: the security deposit is equal to 1 month rent. If there is no damage, the security deposit will be fully refunded to you upon your departure. If there is any damage, the remaining security deposit will be refunded after 1 month after deducting the amount to cover these damages.
VI. Cancellation Policy
In case of cancellation of your reservation, the following conditions will be applied: The full amount paid will be refunded only if the Owner finds a new tenant within your same period of stay and upon the end of this stay.
The Owner will inform the Client immediately if the requested apartment will not be available for whatever reason for the time requested and offer a comparable substitute. If the offered substitute is not acceptable to the Client this contract will be deemed null and void and all deposits previously accepted shall be immediately refunded
In the case that the apartment is destroyed or considerably damaged BEFORE the beginning of the rental, the Client will be notified by e-mail and completely reimbursed as soon as possible. In the case of misunderstanding, the owner will in no case be responsible to the renter for a sum exceeding the total price of the rental.
VII. The Client is Responsible
1. For all deterioration of the property and its contents caused by you or by a member of your group or by one of your guests. You are also responsible for all damages sustained by a third party and which result from an act committed by you or by a member of your group or by a guest invited by you or a member of your group.
2. for the state of cleanliness of the property at the end of your stay. Any violation on your part or on the part of a member of your group can lead to a deduction of your security deposit and even additional costs if the deterioration exceeds the amount of your security deposit.
As part of the check in process, the Client agrees to sign the State of the Apartment document as well as the list of all rules applying to rentals in one of our apartments. Upon arrival at the apartment, should the Client note any damage or missing items, the Client must call the Owner the same day to inform the Owner of these discrepancies, or it will be agreed that the apartment is in the state as agreed to in the State of the Apartment document. The security deposit will be returned to the Client once the State of the Apartment has been verified either on the day of departure or within 24 hours of the clients' departure once the Owner agrees that no damage has occurred and no items are missing.
VIII. The Owner is required to
1. Respect the general conditions and not request additional charges unless these are stipulated in the “Special Conditions” of the apartment.
2. Supply the Client with household linens and towels upon arrival.
3. Respect the commitments undertaken with The Client during the e-mail exchanges.
4. Return the security deposit upon the Client’s departure after check-out.
IX. Sleeping Capacity of the Apartment In no case is the number of renters to be superior to the sleeping capacity of the apartment, which is stipulated in the contract.
X. Price Guarantee The price of the stay is guaranteed with the approval of your reservation.
THE OWNER HAS THE RIGHT TO EVICT, WITHOUT ANY PRIOR WARNING, ALL CLIENTS WHO DO NOT ADHERE TO THE ABOVE STATED REGULATIONS IN THIS CONTRACT.
